GENERAL OBJECTIVE:
The Lawyer is responsible for providing legal information, counselling, assistance and representation to vulnerable individuals in order to obtain, replace, correct or retrieve civil and identity documentation, and to resolve related legal barriers. The Lawyer plans and delivers face-to-face legal awareness sessions on civil documentation processes and procedures, and ensures that every legal intervention is accurately documented so that the project’s data collection and impact study rest on complete, confidential and good-quality case data.
The Lawyer works under the technical supervision of the Protection and Education Project Manager and in close coordination with protection and education team and MEAL Officer, and is expected to maintain constructive working relationships with the Civil Status Affairs Directorate and courts.
RESPONSABILITIES

TASKS :
Responsibility 1:
- Conduct legal intake interviews with beneficiaries in a confidential, gender-sensitive and disability-inclusive manner to identify the legal issue, assess the legal need and determine eligibility against the project’s legal aid criteria.
- Provide accurate, up-to-date legal counselling on civil and identity documentation, including but not limited to: unified national ID card, Iraqi nationality certificate, civil status (family) ID, birth and death certificates, marriage and divorce registration, residency cards, housing cards and PDS ration cards.
- Provide legal counselling and assistance on related legal barriers that block documentation, including late and retrospective birth registration, proof of paternity and filiation, correction of records, registration of children born of unregistered or unrecognised marriages, security clearance requirements, perceived-affiliation obstacles, and cases at risk of statelessness.
- Prepare, review and submit administrative applications and supporting files to the Civil Status Affairs Directorate, Directorate of Nationality, Residency Directorate and other administrative bodies.
- Provide legal representation before the competent courts and administrative bodies for cases requiring judicial resolution to obtain documentation
- Accompany, or arrange accompaniment for, beneficiaries to administrative offices and courts where their circumstances require it; conduct home visits.
- Assess on an individual basis, and recommend to project manager, the need for financial support to cover administrative fees, legal fees, or transport allowance for beneficiaries to attend administrative or court proceedings; submit all supporting invoices and receipts to the project manager in line with TGH finance procedures.
- Provide timely feedback to internal case management staff and to referring agencies on the status and outcome of referred cases; participate in complex case meetings and case conferences where a legal issue is present, when requested by the project manager.
- Identify cases falling outside the project’s legal aid scope and refer them, with the beneficiary’s informed consent, to the appropriate internal or external service provider through established referral pathways.
- Immediately refer protection concerns identified during legal work including child protection cases, GBV and cases of persons with specific needs, following TGH SOPs, safe referral standards and survivor-centred principles.
Responsibility 2:
- Plan, schedule and conduct face-to-face legal awareness sessions for individuals and groups on civil documentation processes, procedures, required supporting documents, authorities
- Develop and update accessible awareness materials including, leaflets, FAQs, sessions materials, and posters in Arabic adapted for participants with low literacy, for women and girls, for older persons and for persons with disabilities
- Ensure sessions are gender- and age-segregated where appropriate, held in safe and accessible locations, delivered at times that allow women and working household members to attend, and preceded by community mobilisation in coordination with protection team.
- Collect attendance data and participant feedback for each session; document questions
Responsibility 3 :
- Accurately and promptly record every legal intervention — intake, counselling, assistance, representation, follow-up, outcome and document obtained in TGH legal case management database / information management system, in line with agreed data standards and indicator definitions.
- Ensure that individual legal files are complete, correctly filed and archived, and that hard-copy and electronic records are stored securely and confidentially in accordance with the TGH data protection policy and informed consent procedures.
- Contribute to the design and roll-out of the project’s legal service data collection tools (intake forms, outcome trackers, awareness session forms, follow-up questionnaires) in collaboration with the Project Manager and MEAL staff.
- Support the impact study by conducting or facilitating follow-up interviews with consenting beneficiaries on whether obtaining documentation improved their access to education, health, employment, freedom of movement, assistance and other rights; obtain and record informed consent for participation and for the use of anonymized data.
- Contribute case studies, success stories, anonymized case examples and trend analysis to the impact study, always with the documented informed consent of the individual and with all identifying details removed.
Responsibility 4 :
- Establish and maintain professional, constructive working relationships with the Civil Status Affairs Directorate, courts, local authorities and mukhtars in the area of operation, in coordination with and with the prior approval of the Project Manager.
- Contribute to the drafting of internal and external reports according to TGH and donor requirements, ensuring quality and timely submission; provide weekly and monthly activity updates and inputs to progress reports, highlighting achievements, challenges and lessons learned.
- Maintain and update knowledge of Iraqi legislation, regulations, circulars and administrative practice affecting civil documentation, and share updates with the legal team.

Required Qualifications & Preferred Skills
- Bachelor’s degree in Law (LL.B.) from a recognized university.
- Valid and active membership / license of the Iraqi Bar Association, entitling the holder to represent clients before the competent courts and administrative bodies. (Mandatory where the role includes court representation.)
- Minimum 3 years of professional legal experience with NGOs, including demonstrated practice before Iraqi courts and/or administrative bodies.
- Practical knowledge of Iraqi civil documentation procedures and of the Civil Status Affairs Directorate, Personal Status Courts, Directorate of Nationality and Residency Directorate.
- Excellent knowledge of the Iraqi legal system, in particular the Civil Status Law, the Personal Status Law, the Iraqi Nationality Law, and related regulations and administrative circulars.
- Sound understanding of international protection principles, human rights standards and the rights of displaced persons, returnees and refugees.
- Proven ability to draft legal documents to a professional standard: petitions, lawsuits, defences, appeals, affidavits and legal memoranda.
- Strong computer literacy
- Fluency in Arabic (spoken and written); working knowledge of English sufficient for reporting.
- Willingness and ability to travel regularly within the area of operation, including to camps and remote, hard-to-reach locations.
- Previous experience with an international or national NGO, UN agency or legal aid organization, particularly in protection or legal aid programming.
- Experience delivering awareness raising, training or community outreach sessions to diverse audiences.
