I. Introduction / background information

Created in 1960, the Foundation of Terre des hommes Lausanne (Tdh) mission is to defend and promote the rights of children, in humanitarian as well as development contexts. Today, Terre des hommes Foundation is the largest non-governmental organization (NGO) for children’s aid in Switzerland. Tdh implements projects and programs in more than 30 countries, including Palestine, Lebanon, Jordan, Egypt and Iraq in MENA.

Terre des hommes Foundation (Tdh) - Iraq Delegation is legally registered in Baghdad since 17/05/2017 under the certificate number 2I8589 and had renewed its registration on the 18/08/2019.

Tdh is registered in the Social Security department since 01/01/2018 under registration number 10267697

Tdh - Iraq Delegation is hiring an accountant to proceed with the monthly calculation of Social Security and Income Tax of Tdh and ensure validation and submission to Social Security Department and Income Tax Department in Baghdad.

II. Objectives of the assignment

The accountant is expected to provide legal advice on Tdh obligations regarding the Social Security and Income Tax regulations and to closely collaborate with Tdh nominated team members to ensure a complete and clear information gathering and sharing. The accountant will be responsible of ensuring the exact calculation of the monthly social security contribution and monthly income tax contribution based on Tdh employees’ list.

III. Scope of work

The accountant is expected

  • To provide periodic (at least twice a year), training sessions for Tdh finance and HR staff on key Social Security and Tax regulations and other key aspects, need for Tdh staff for the right proper preparations.

  • To provide monthly calculation of Tdh Social Security payments on due date

  • To provide monthly calculation of Tdh Income Tax payments on due date

  • To ensure the submission and approval to the relevant official departments in Baghdad

  • To provide Tdh with the invoice, payment instructions and then ensuring payment receipt from the Social security and Income Tax departments

  • To update Tdh in writing in when updates/changes are made to the legislation in regards of social security and income tax. Also advice Tdh on suitable / necessary course of action to be in compliant the new / changed legislation.

Income Tax

1.     Establish total amount of Income Tax to be paid on a monthly basis based on Tdh staff list information

3.     Ensure, guide, and support the Tdh team to the transfer / payment of the total (accurate) amount of Income Tax due on a monthly basis

1 month after signature of the contract

 

 

1.     Advice and support the Tdh team in accurately factoring in staff leave and absence from work into the SS and IT calculations.

 

 

Social Security

2.     Establish total amount of Social Security to be paid on a monthly basis based on Tdh staff list information

3.     Ensure submission and validation of the Social Security to be paid on a monthly basis

4.     Ensure, guide and support the Tdh team to the transfer / payment of the total (accurate) amount of to Social Security due on a monthly basis

V. Duration of the assignment

The service contract between Tdh and the accountant will be valid for a year from the date of signature

VI. Terms of Payment

Tdh agrees to pay the amount of XXXXX USD on a monthly basis after full completion of the monthly deliverables, through bank transfer as per the banking information given by the accountant.

VII. Qualifications
  • Advanced Degree in Economics / Law with specialization in Social Security and Income Tax
  • At least Ten years of experience in providing legal guidance specifically to NGO Sector / or working in relevant governmental institutions in Iraq
  • Proven experience and knowledge of NGO legislation in Iraq
  • Excellent reporting and analytical skills
  • Excellent communication skills
  • Languages: Fluent in Arabic & English is an advantage.
  • Identity of the Syndicate of Accountants and Auditors.
  • Financial offer form signed and stamped;
  • Registration documents “Commercial Register” and “Profession licence”.
  • References of current NGO clients

VIII. Ethical considerations

The consultant/consulting agency must sign the Terre des hommes Child Safeguarding Policy and Code of Conduct and be willing to adhere to its principles and expected practices. If a breach of the policy or code of conduct takes place the consultancy will be terminated immediately without any financial burden on Tdh.

IX. Disclaimer on copyright, data protection

All documents, project designs, drawings, data and information shall be treated as confidential and shall not without the written approval of Tdh be made available to any third party. In addition, the consultant(s) formally undertakes not to disclose any parts of the confidential information and shall not, without the written approval of Tdh be made available to any third party. The utilization of the report is solely at the decision and discretion of Tdh. All the documents containing both raw data/materials provided by Tdh and final report, both soft and hard copies are to be returned to Tdh upon completion of the assignment. All documentation and reports written as, and as a result of the research or otherwise related to it, shall remain the property of Tdh. No part of the report shall be reproduced except with the prior, expressed, and specific written permission of Tdh.

The attorney(ies) will work directly with the Country Representative, the Senior Management Team and the Finance, Admin and HR Coordinator of Tdh Iraq.
