| How does Dorcas decide who wins the Contract? | ||||
| 1. | Dorcas holds an Evaluation Committee made up of at least 5 members. | |||
| 2. | Dorcas evaluates Tender responses on the evaluation criteria set out below. If Dorcas has previous history with the Contractor / company, this will be taken into consideration. | |||
| 3. | Dorcas also considers the ethical policy and practice of the contractor/ company | |||
| 4. | The successful Contractor/Company(s) will be contacted in order to begin contract finalization. | |||
| كيف تقرر Dorcas من الذي سيفوز بالعقد؟ 1. تقوم Dorcas بتعيين لجنة تقييم مؤلفة من 3 اعضاء كحد أدنى. 2. تقوم Dorcas بتقييم العطاءات المقدمة وفق المعايير المبينة ادناه. واذا كانت هناك اعمال سابقة بين Dorcas والمجهز فسوف تؤخذ بنظر الاعتبار. 3. كما إن Dorcas تأخذ بنظر الإعتبار أيضا السياسة الاخلاقية وتمرس المجهز. 4. سيتم الاتصال بالمجهز الذي ترسو عليه الاحالة ويتم التعاقد معه. |

| Notice to Constructors/ companies | ||||
| 1. | Dorcas may reduce or increase the quantity of any item before the awarding date | |||
| 2. | Unit prices should be in US dollar. And offers must remain the same even if there is a reduction in the quantities of the order by up to 20%. | |||
| 3. | Offers must be valid for 6 month. 4. The winning company must present a certified check of 10% of the project value, and it will be returned after the maintenance period (6 months) after the end of the project. Any delay in the project implementation period will be deducted daily by 0.2% of the project value. |

| ملاحظة الى المقاولين 1. قد تقوم Dorcas بتقليص او زيادة كمية اية مادة قبل تاريخ الاحالة 2. يجب ان يكون سعر الوحدة بالدولار الامريكي في العطاء . ويجب ان يبقى ثابتا حتى لو حدث تقليص في الكميات في المناقصة لحد 20%. 3. يجب ان تكون العطاءات نافذة لمدة 6 اشهر . 4. على الشركة الرابحة تقديم صك مصدق بقيمة 10% من قيمة المشروع ويسترجع بعد فترة الصيانة (6 أشهر)بعد أنتهاء المشروع وأي تأخير في مدة تنفيذ المشروع يخصم يوميأ 0.2% من قيمة المشروع. |

| A - Code of Conduct for Suppliers | ||||
| ”No offer, payment, consideration or benefit of any kind, which could be regarded as an illegal or corrupt practice, shall be made, promised, sought or accepted - neither directly or indirectly - as an inducement or reward in relation to activities funded under this agreement, incl. tendering, award or execution of contracts. Any such practice will be grounds for the immediate cancellation of this agreement/contract and for such additional action, civil and/or criminal, as may be appropriate. | ||||
| The conduct of the supplier should not violate the basic rights of Dorcas's intended beneficiaries. | ||||
| أ - قواعد السلوك للمجهزين | ||||
| "لا يسمح بأي عرض او تسديد او اعتبار او منفعة من أي نوع مما يمكن اعتباره تصرفا غير قانوني او فسادا قد يتم طرحه او الوعد به او القبول به او طلبه - سواء كان ذلك مباشرا ام غير مباشر - كإغراء او مكافأة تتعلق بالنشاطات التي يتم تمويلها تحت هذه الاتفاقية بما في ذلك تقديم العطاء ورسو الاحالة او تنفيذ العقود. ان أي ممارسة من هذا النوع ستكون سببا للإلغاء الفوري لهذه الاتفاقية/ العقد بالاضافة الى ما يترتب عن عمل كهذا من تبعات مدنية او جنائية حسبما يقتضي. | ||||
| إن سلوك المجهز يجب ان لا يخرق الحقوق الاساسية لمستفيدي Dorcas المراد خدمتهم. | ||||
| B - Ineligibility Criteria Tenderers falling into any of the following cases are excluded from participation in the procurement procedure: |
||||
| (a) | They are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations; | |||
| (b) | They have been convicted of an offence concerning their professional conduct by a judgement that has the force of res judicata; | |||
| (c) | They have been guilty of grave professional misconduct proven by any means that the contracting authority can justify; | |||
| (d) | They have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed; | |||
| (e) | They have been the subject of a judgment that has the force of res judicata for fraud, corruption, involvement in a criminal organization or any other illegal activity detrimental to the Communities' financial interests; | |||
| (f) | Following another procurement procedure or grant award procedure financed by the European Community budget, they have been declared to be in serious breach of contract for failure to comply with their contractual obligations. | |||
| (g) | They are engaged in the exploitation of child labor | |||
| (h) | They do not respect their employees’ basic social rights and working conditions. | |||
| Candidates or tenderers must provide a written statement with their tender documents that they are not in one of the situations listed above. | ||||
| ب - معيار عدم الجدارة ان اصحاب العطاءات الذين يقعون في أي من الحالات التالية سيتم استبعادهم من المشاركة في عملية التجهيز: (أ) كونهم في حالة افلاس او لديهم دعاوى في المحاكم وتدار شؤونهم من قبل المحاكم والذين لديهم ترتيبات تصفية مع الدائنين والذين قاموا بإيقاف نشاطاتهم التجارية والذين لديهم معرضون لإجراءات تتعلق بهذه الأمور أو الذين هم تحت أي حالة مماثلة تنشأ عن اجراءات مماثلة وفق التشريعات والتعليمات الوطنية؛ (ب) الذين هم مدانون بارتكاب مخالفة تتعلق بتصرفاتهم المهنية من قبل جهة قضائية لها صلاحية الحكم فيها. (ج) انهم مذنبون بسوء تصرف مهني خطير تم اثباته بأية وسيلة يمكن للسلطة المتعاقدة تبريره؛ (د) انهم لم ينجزوا التزاماتهم المتعلقة بتسديد مبالغ الضمان الاجتماعي او تسديد الضرائب بموجب احكام القانون في بلادهم التي أسسوا فيها او مع الذين هم من بلاد السلطة المتعاقدة او مع الذين هم من البلاد التي سينفذ فيها العقد؛ (هـ) انهم خضعوا لحكم من قبل سلطة قضائية في قضية احتيال او فساد، او اشتراك في منظمة ارهابية او أي نشاط غير قانوني يضر بالمصالح المادية للمجتمع؛ (و) دخلوا في عملية تجهيز اخرى او منحة ممولة من ميزانية مجموعة الدول الاوربية، وقد قاموا بخرق جدي في العقد ناجم عن الفشل في اداء التزاماتهم التعاقدية. (ز) انهم مشتركون في استغلال عمالة الاطفال (ح) انهم لا يحترمون الحقوق الاجتماعية الاساسية لموظفيهم وشروط العمل يجب على المرشحين او اصحاب العطاءات تقديم تصريح خطي بوثائق العطاء الخاص بهم مما لم يذكر في اعلاه. |

| C - Grounds for Exclusion | ||||
| Contracts shall not be awarded to candidates or tenderers who, during the procurement procedure: | ||||
| (a) | Are subject to a conflict of interest; | |||
| (b) | Are guilty of misrepresentation in supplying the information required by the humanitarian organization as a condition of participation in the contract procedure or fail to supply this information. | |||
| (c) | Have engaged in corrupt, fraudulent, collusive or coercive practices. | |||
| جـ - قواعد الاستثناء لن تعطى العقود الى المرشحين او اصحاب العطاءات الذين يقومون بما يلي اثناء توفير المواد: (أ) لديهم صراعات على المصالح (ب) مذنبون في تقديم معلومات مغلوطة مما تطلبه المنظمة الانسانية كشرط للمشاركة في عملية التعاقد او ممن فشلوا في تقديم هذه المعلومات. (ج) مشتركون في الفساد، الاحتيال، واعمال تواطؤ وتسلط قسري. |
